Dual use of this technology has caused complexity and confusion amongst the nations. The nuclear law came to existence after the access of some states to the full aspects of this technology. Obviously the latter rules have stopped the rest of the world gaining access to the dual usage of nuclear while the previous nuclear states insist in keeping a right to maintain their superior technology. This paper will argue this issue from the legal, commercial and human rights perspective in more depth and wishes to seek any possible resolutions or recommendations to solve this international dispute amongst the nations. One of the other contributions of this thesis is to assess the inadequacy of some of the NPT articles and the main role of the IAEA to encourage the members to use the technology for peaceful purposes and the prohibition of its diversion into military ones. These flaws include the failure of the suppliers to supply adequate support to some of the non-nuclear states, mostly in developing countries, the lack of a proper timetable to eliminate nuclear weapons and the states selective interpretation of the NPT for nuclear trade and developments.

Book excerpt: As currently interpreted, it is difficult to see why the Nuclear Nonproliferation Treaty (NPT) warrants much support as a nonproliferation convention. Most foreign ministries, including that of Iran and the United States, insist that Article IV of the NPT recognizes the "inalienable right" of all states to develop "peaceful nuclear energy." This includes money-losing activities, such as nuclear fuel reprocessing, which can bring countries to the very brink of acquiring nuclear weapons. If the NPT is intended to ensure that states share peaceful "benefits" of nuclear energy and to prevent the spread of nuclear bomb making technologies, it is difficult to see how it can accomplish either if the interpretation identified above is correct. Some argue, however, that the NPT clearly proscribes proliferation by requiring international nuclear safeguards against military diversions of fissile material. Unfortunately, these procedures, which are required of all non-nuclear weapons state members of the NPT under Article III, are rickety at best. Each chapter of this book is dedicated to clarifying the NPT's key ambiguities, and the chapters are roughly structured to trace the NPT's text, article by article. The analysis set forth here was mostly written or commissioned by the Nonproliferation Policy Education Center. Much more, of course, could have been included in this book. But rather than seeking to be comprehensive, the aim throughout is to provide a guide for both policymakers and security analysts. This guide should assist in navigating the most important debates over how best to read and implement the NPT and, in the process, spotlighting alternative views of the NPT that are sound and supportable. Book excerpt: The nuclear development programs of both Argentina and Brazil have, since the 1970s, been premised on the desire for self-sufficiency and assurance of nuclear fuel supply. While military rivalry and mutual distrust led to nuclear weapons related development programs in the 1970s and 1980s, both countries have since terminated these programs. Furthermore, the governments of both countries have pledged their commitment to exclusively non-explosive use of nuclear energy and have signed the Non Proliferation Treaty (NPT). Utilizing rights provided for under the NPT, both Argentina and Brazil have nuclear fuel production facilities, with the notable exception of enrichment plants, that provide much of the current indigenous fuel requirements for their nuclear power plants. However, both countries are actively developing enrichment capability to fill this gap. The purpose of this report is to assess the economic basis and non-proliferation policy considerations for indigenous enrichment capability within the context of their desired self-sufficiency and to evaluate possible United States Government policy options.

Book excerpt: When we are looking at proliferation cases, there are a number of lessons – positive and negative – learnt. First, facts reported by the IAEA are essential for the international community in assessing the compliance and risks of possible clandestine activities. Second, the IAEA verification scheme is biting when it fully exercises its verification rights, and when it is provided with the requisite cooperation. Third, when countries face questions raised by the IAEA, those that chose to turn the course and / or cooperated to remove concerns and ambiguities resolved their nuclear dossiers in a satisfactory manner and fairly swiftly. Fourth, when states adopt the course of confrontation, as are currently the cases with Iran, Syria and North Korea, the situation becomes more complicated and more difficult to resolve. Fifth, dragging non-compliance and challenging of the authority of the United Nations Security Council and the IAEA Board of Governors erodes the international non-proliferation regime. This book addresses two proliferation cases, Iran and North Korea providing extensive snapshots on the currently known nuclear programs, and analyses failures and weaknesses of past verification activities, and makes innovative suggestions for ways forward.
